On 31 December 2025, the Ministry of Industry and Trade of Vietnam issued Decision No. 3804/QD-BCT on the initiation of a new shipper review in the case concerning the application of anti-circumvention trade remedy measures on certain sugar products (case number: NR04.AC02.AD13-AS01). The scope, contents, and duration of the review are specifically stipulated in Decision No. 3804/QD-BCT and the accompanying Notice.
Pursuant to the above Decision, the Trade Remedies Authority of Vietnam, acting as the investigating authority, has officially issued review questionnaires to the relevant foreign producers and exporters in order to collect information for the purpose of the investigation. The deadline for submission of questionnaire responses is 25 February 2025 (Hanoi time).
In order to ensure the protection of their lawful rights and interests, the investigating authority requests the relevant foreign producers and exporters to participate fully and cooperate closely throughout the investigation.
In cases where an enterprise fails to submit its response by the prescribed deadline or provides inaccurate or incomplete information as required, the investigating authority will rely on the facts available to make its determination in accordance with Article 75 of the Law on Foreign Trade Management.
The provision and handling of information and data during the questionnaire response process, as well as the rights of interested parties to access information in the case, will be conducted in compliance with the confidentiality requirements set out in Article 11 of Decree No. 86/2018/ND-CP dated 15 January 2018 of the Government, detailing a number of provisions of the Law on Foreign Trade Management regarding trade remedy measures.
Detailed instructions on how to complete each section of the questionnaire, the form of submission, and the applicable deadlines are clearly specified in the questionnaire issued to enterprises. Accordingly, the investigating authority recommends that enterprises carefully review the guidance, prepare complete documentation, and submit their responses within the prescribed time limits.
