On 26 December 2025, the Ministry of Industry and Trade issued Decision No. 3765/QĐ-BCT on the final results of the sunset review of the application of anti-dumping measures on certain cold-rolled (cold-pressed) steel products originating in the People’s Republic of China under Case No. ER01.AD08.
Pursuant to this Decision, the anti-dumping measures continue to be maintained in order to protect the domestic industry against the risk of dumped imports causing significant injury.
The cold-rolled steel products subject to anti-dumping duties are identified by specific HS codes, including: 7209.16.10; 7209.16.90; 7209.17.10; 7209.17.90; 7209.18.91; 7209.18.99; 7209.26.10; 7209.26.90; 7209.27.10; 7209.27.90; 7209.28.10; 7209.28.90; 7209.90.90; 7211.23.20; 7211.23.30; 7211.23.90; 7211.29.20; 7211.29.30; 7211.29.90; and 7225.50.90.
The clear identification of HS codes enables importing and end-using enterprises to proactively review their tax obligations as well as their eligibility for exemption in accordance with applicable regulations.
With respect to the exemption mechanism for trade remedy measures, Article 12 of Circular No. 26/2025/TT-BCT dated 15 May 2025 of the Ministry of Industry and Trade sets out in detail the principles and specific circumstances under which exemptions may be considered, on the basis of ensuring that the overall effectiveness of the applied trade remedy measure is not undermined.
Accordingly, the Minister of Industry and Trade is authorized to consider granting exemptions in certain cases, taking into account production and business realities and domestic market demand.
Specifically, imported goods subject to trade remedy measures may be considered for exemption if they fall into one of the following circumstances: goods listed as eligible for exemption under the decision imposing the measure or the review results; goods that the domestic industry is unable to produce; goods with distinctive characteristics for which domestic products cannot serve as substitutes; goods that are special products of similar or directly competitive goods; cases where similar or directly competitive domestically produced goods are not sold on the domestic market under normal conditions or where force majeure events result in supply shortages; or imported goods used for research and development or other non-commercial purposes within the total volume eligible for exemption.
On the basis of the above provisions, in particular Articles 12 and 17 of Circular No. 26/2025/TT-BCT, the trade remedy authority hereby announces the acceptance of applications for exemption from anti-dumping duties on cold-rolled steel products under Case No. ER01.AD08. Enterprises that fully satisfy the prescribed conditions may prepare and submit exemption applications, including the documents specified in Article 16 and Appendix II of Circular No. 26/2025/TT-BCT.
Pursuant to Clause 3 Article 17 and Article 18 of Circular No. 26/2025/TT-BCT, exemption applications may be submitted directly, by post, or via the Ministry of Industry and Trade’s online public service portal. Proper submission in the correct form, with complete documentation and in compliance with technical requirements, constitutes an important basis for the application to be reviewed and appraised in accordance with the prescribed legal procedures.
