On September 14, 2024, the Cambodian government unveiled its new IP recordation system portal during a workshop at the National Customs School. Now, two weeks later, the system is fully operational.
Accessible through the General Department of Customs and Excise (GDCE) website (https://lnkd.in/g6UkZfSj), the portal requires users to create an authorized account. Currently, there is no official fee for utilizing the system and it is not yet fully comprehensive.
The system allows for the recordation of trademarks in Cambodia, geographical indications, and copyrights, but does not yet include patents, utility models, or industrial designs. It remains to be seen whether these forms of IP will be incorporated in the future.
Additionally, recordation is valid for the duration of the IP right, such as 10 years from the filing date of a trademark application. A new recordation will be required upon renewal of a trademark registration or exclusive rights agreement, as the system does not automatically carry over previous data upon renewal.
Finally, there will be no official certificate or confirmation of recordation issued by the system. Instead, users will rely on the “accepted” status of their request in the online portal, with processing typically completed within two business days.
The Cambodia’s Customs Administration was promoted from “Directorate of Customs and Excise” to “General Department of Customs and Excise of Cambodia” by Subdecree 134 ANK.BK dated 15 September 2008. Subsequently, its internal management has been continuously restructured according to the volume of works and responsibilities.
