The United States terminates scope inquiry on Vietnamese steel wheels

On April 30, 2024, the United States Department of Commerce issued a notice to terminate the scope inquiry concerning steel wheels imported from Vietnam.

On August 7, 2023, the DOC initiated a scope inquiry concerning steel wheels imported from Vietnam. The petitioner was Dexstar, a U.S. company, which was also the petitioner in the U.S. anti-dumping and countervailing duty investigation on steel wheels from China in 2019.

Specifically, Dexstar requested the DOC to investigate whether finished products in Vietnam made from Chinese-origin components (discs or rims) fell within the scope of the duties that the United States was applying to China, thereby constituting circumvention of the trade remedy measures applied to Chinese companies.

According to section 351.225(f)(6) of the U.S. Customs Law, the investigating authority issues a notice of intent to terminate an investigation if there is insufficient evidence to prove that Vietnamese companies import components of trailer wheels (discs or rims) from China for the production of trailer wheels, as alleged by the petitioner.

The DOC found no clear evidence that Vietnamese companies import steel sheet materials from China to produce trailer wheel discs and rims. Currently, the DOC is seeking comments from interested parties.

The petitioner responded to the DOC, stating that they did not oppose the decision to terminate the investigation concerning Vietnamese companies but requested the DOC to consider initiating a circumvention inquiry through assembly or finishing in a third country based on this case’s records.

This proposal was opposed by U.S. importers, arguing that it lacked merit. The DOC subsequently rejected the petitioner’s proposal due to insufficient evidence.
