On May 1, 2024, the United States Department of Commerce announced the initiation of the first sunset review concerning the anti-dumping duty and countervailing duty orders on laminated woven sacks imported from Vietnam.
The investigated product is laminated woven sacks, with HS codes 6305.33.0040, 3917.39.0050, 3921.90.1100, 3921.90.1500, 3923.21.0080, 3923.21.0095, 3923.29.0000, 4601.99.0500, 4601.99.9000, 4602.90.0000, and 5903.90.2500.
This product was previously subject to anti-dumping and countervailing duty investigations by the United States in 2018, with duties applied since 2019. The anti-dumping duties range from 109.46% to 292.61%, and countervailing duties range from 3.02% to 198.87%.
According to the U.S. trade remedy regulations, sunset reviews in trade remedy investigations will be conducted periodically every five years. If the review results indicate that revoking the trade remedy measures could lead to continued or recurring dumping or subsidization causing injury to the domestic industry, the duty orders will be extended for another five years.
Additionally, it should be noted that unlike interim reviews where duty rates may change based on investigation results, in sunset reviews, there are only two possible outcomes: termination or continuation of the duty orders. The review results will not affect the duty rates applied.
According to regulations, there is no limit to the number of sunset reviews within one investigation, depending on the review results. Hence, a product could be subject to duties for decades, undergoing indefinite reviews if previous sunset review results show no changes in dumping or subsidization behavior.
Typically, the U.S. Department of Commerce will not revoke duty orders if the investigating authority determines that revocation could lead to continued or recurring dumping or subsidization based on:
(1) the dumping margin remaining above the minimum level after the duty orders were issued;
(2) cessation of imports under investigation after the duty orders were issued; or
(3) no more dumping after the duty orders were issued, and a significant reduction in imports of the investigated product.
According to U.S. regulations, parties wishing to participate as interested parties need to submit notices within 10 days from the date of publication of the initiation notice.
