Recently, the Ministry of Industry and Trade of Vietnam issued an official announcement regarding the formal acceptance of applications for the end-term review of anti-dumping measures against aluminum products exported from China to Vietnam.
On September 28, 2019, the Minister of Industry and Trade issued Decision No. 2942/QD-BCT on the official application of anti-dumping measures against certain aluminum products originating from China.
Decision No. 2942/QD-BCT is effective for a period of 5 years from the date of issuance. Goods subject to the official anti-dumping duty are classified under the following HS codes: 7604.10.10; 7604.10.90; 7604.21.90; 7604.29.10; 7604.29.90.
The list of HS codes may have been modified by the Ministry of Industry and Trade to align with the description of the investigated goods and other changes (if any).
According to Decision No. 2942/QD-BCT, the investigating authority concluded that there is: (i) a practice of dumping, (ii) significant injury to the domestic manufacturing industry, and (iii) a causal link between the import of dumped goods and the injury to the domestic manufacturing industry.
Decision No. 2942 lists the names of 15 groups of companies producing the investigated products, subject to official anti-dumping duties ranging from 2.49% to 35.58%. The general duty rate applicable to other companies producing the investigated products is 35.58%.
Vietnam is now accepting applications for the end-term review of anti-dumping measures against aluminum products from China
In accordance with the provisions of Article 82, Clause 2 of the Law on Foreign Trade Management, one year before the expiration of the anti-dumping measures, the Minister of Industry and Trade shall decide to conduct an end-term review of the application of anti-dumping measures.
The details of the end-term review are specified in Article 82, Clause 2 of the Law on Foreign Trade Management and Article 63 of Decree No. 10/2018/ND-CP dated January 15, 2018, detailing certain provisions of the Law on Foreign Trade Management regarding trade remedy measures.
Therefore, the Administration of Trade Remedy, Ministry of Industry and Trade of Vietnam, officially opens the acceptance of applications for the end-term review of anti-dumping measures against aluminum products exported from China to Vietnam.
According to the provisions of Article 62, Clause 2 of Decree No. 10/2018/ND-CP, within 30 days from the date of the notification by the investigating agency, domestic manufacturers have the right to submit applications for the end-term review of anti-dumping measures. The deadline for the Administration of Trade Remedy of Vietnam to receive applications is August 4, 2023.
