(Vietnam) On January 28, 2022, the Ministry of Industry and Trade issued Decision No. 117/QD-BCT on the final review of safeguard measures for DAP and MAP fertilizers with HS code: 3105.10.20; 3105.10.90; 3105.20.00; 3105.30.00; 3105.40.00; 3105.51.00; 3105.59.00; 3105.90.00 imported into Vietnam.
On March 2, 2018, the Minister of Industry and Trade had issued Decision No. 686/QD-BCT on the application of safeguard measures for DAP and MAP fertilizer products imported into Vietnam with HS code: 3105.10.20; 3105.10.90; 3105.20.00; 3105.30.00; 3105.40.00; 3105.51.00; 3105.59.00; 3105.90.00 in 2 years.
After 2 years, on March 3, 2020, the Ministry of Industry and Trade issued Decision No. 715/QD-BCT extending the application of safeguard measures to DAP and MAP imported products.
On October 20, 2021, the Trade Remedies Department issued announcements No. 24/TB-PVTM, published publicly on the website of the Trade Remedies Department (investigating agencies) and the Ministry of Industry and Trade, regarding the reception of the dossier of request to review the final investigation phase of the safeguard measures for DAP, MAP imported fertilizer products (according to Article 69 of Decree 10/201/ND-CP).
On November 19, 2021, the Trade Remedies Department received a dossier of requests for safeguard measures for DAP and MAP fertilizer products imported into Vietnam. On December 1, 2021, the Trade Remedies Department issued Official Letter No. 961/PVTM-P2 demanded the requesting Party to supplement the dossier, and by the end of December, on December 29, 2021, the Trade Remedies Department received additional information from the requesting party. After that, on December 31, 2021, the Trade Remedies Department issued Official Letter No. 1046/PVTM-P2 on the confirmation of a complete and valid dossier.
After examining the dossier and determining the information in the dossier is valid, on January 28, 2022, the Ministry of Industry and Trade issued Decision No. 117/QD-BCT on the final review of the safeguard measure for imported DAP and MAP fertilizers.
Questionnaire for domestic producers, importers of the case of the end-of-term review of safeguard measures for imported DAP and MAP fertilizers
Pursuant to the provisions of Article 57 of Decree 10/2018/ND-CP, the investigation questionnaire for related parties has been issued by the investigating agency to serve the investigation of the case.
Accordingly, the Trade Remedies Administration requests the relevant parties to provide truthfully and accurately, in detail the information in the investigation questionnaire for the final review of safeguard measures for imported DAP and MAP fertilizers as soon as possible.
The survey questionnaire is publicly posted on the website of the Department of Trade Remedies and the Ministry of Industry and Trade.
Pursuant to the provisions of Article 57 of Decree 10/2018/ND-CP, the deadline for receiving the questionnaire is before 5:00 p.m. on March 20, 2022.
