Recently, the Ministry of Industry and Trade of Vietnam issued an official announcement regarding the acceptance of review applications for the application of trade remedy measures on sugar from Thailand.
On June 15, 2021, the Ministry of Industry and Trade issued Decision No. 1578/QD-BCT on the imposition of anti-dumping and countervailing duties on certain sugar products originating from Thailand (case code AD13-AS01).
On August 1, 2022, the Ministry issued Decision No. 1514/QD-BCT on the application of anti-circumvention measures regarding trade remedy on certain sugar products imported from Cambodia, Indonesia, Laos, Malaysia, and Myanmar (case code AC02-AD13.AS01).
On August 3, 2023, the Ministry issued Decision No. 1989/QD-BCT on the results of the first review of the application of anti-dumping and countervailing measures on certain sugar products originating from Thailand (case code AR01.AD13-AS01).
According to Article 82, Clause 1, and Article 90, Clause 1 of the Law on Foreign Trade Management, one year after the decision to apply anti-dumping or countervailing measures, the Minister of Industry and Trade has the authority to decide on the review of the application of such measures upon the request of one or more related parties in the investigation and based on the consideration of the evidence provided by the requesting party.
As stipulated in Decree No. 10/2018/ND-CP, the parties involved in the case have the right to submit an application requesting a review of the application of anti-circumvention measures on trade remedy and the application of anti-dumping and countervailing measures on imported sugar products. The deadline for the Trade Remedies Authority to receive applications is no later than August 3, 2024.
