On August 12, 2024, the USA Department of Commerce (DOC) issued the expiry conclusion of the second expiry review of the anti-dumping duty order on wind towers classified under HS codes 7308.20.0020 and 8502.31.0000, imported from Vietnam.
According to the Tariff Act of 1930, the USA Department of Commerce automatically conducts expiry reviews every five years for anti-dumping and countervailing duty orders as per the list provided by the DOC. The USA International Trade Commission (ITC) simultaneously announces this notice regarding the periodic five-year review of similar duty orders and currently suspended investigations.
The products subject to this expiry review are wind towers with HS codes 7308.20.0020 and 8502.31.0000. Vietnamese wind towers were initially investigated for anti-dumping by the USA in 2012, resulting in the imposition of duties in 2013, ranging from 51.54% to 58.54%.
This is the second expiry review initiated by the USA concerning Vietnamese wind towers. If the review concludes that the cessation of anti-dumping duties may lead to the continuation or recurrence of dumping, causing significant damage to the domestic industry producing similar products in the USA, the duty order will be extended for an additional five years.
According to the DOC’s conclusion issued on August 12, 2024, the cessation of anti-dumping duties on wind towers imported from Vietnam could likely result in the continuation or recurrence of dumping, with a weighted-average dumping margin of up to 58.24%.
As a result, the anti-dumping duty order on Vietnamese wind towers will be extended by the DOC for another five years. New Vietnamese exporters (if any) are advised to contact the DOC before exporting to the USA market to have their individual duty rate calculated; otherwise, they will be subject to the nationwide rate of 58.24%.
