On June 18, 2025, the U.S. Department of Commerce (DOC) officially announced the Final Determination of the 20th administrative review (POR20) of the anti-dumping duty order on frozen pangasius fillets imported from Vietnam, covering the period from August 1, 2022 to July 31, 2023.
In this review, eight Vietnamese exporters participated, with two companies selected by the DOC as mandatory respondents.
Previously, on September 17, 2024, the DOC issued its Preliminary Determination, which determined a preliminary anti-dumping duty rate of USD 0.00/kg for both mandatory respondents. The remaining six companies also qualified for separate rates, all at USD 0.00/kg. As the petitioner withdrew its request for the review of the Vietnam-wide rate, the existing country-wide duty rate of USD 2.39/kg remained in effect.
In the Final Determination, the DOC affirmed the Preliminary Determination. Specifically:
- One of the two mandatory respondents continues to receive a zero anti-dumping duty rate (USD 0.00/kg);
- The other respondent was excluded from the order effective January 17, 2025, and is therefore no longer subject to this review;
- The six remaining companies continue to receive separate rates of USD 0.00/kg, based on the rate of the qualified mandatory respondent.
As for the Vietnam-wide rate, the DOC maintains the rate at USD 2.39/kg, citing that the only remaining request for review submitted by Luscious Seafood LLC was found invalid. According to the DOC, Luscious Seafood did not operate as a wholesaler of the subject merchandise in the U.S. during the review period, and therefore lacked legal standing to request the administrative review. Based on this, the DOC decided to rescind the review of the Vietnam-wide rate.
Cash Deposit Requirements Following POR20 Final Determination
The following new cash deposit requirements will take effect from the date of publication of the Final Determination:
- For the named companies in the Final Determination: the cash deposit rate will correspond to the final dumping margins determined (i.e., if the rate is zero or de minimis, the cash deposit will also be zero);
- For exporters previously reviewed and granted separate rates, but not listed in this review: the current cash deposit rates remain unchanged;
- For all other Vietnamese exporters not granted a separate rate: the Vietnam-wide rate of USD 2.39/kg will apply.
These rates will remain in effect until further notice.
Implications for Vietnam’s Pangasius Export Sector
The Final Determination of POR20 are a positive development for Vietnam’s pangasius industry, particularly as this product is one of the country’s key export items, generating approximately USD 2 billion annually and accounting for 20% of Vietnam’s total seafood export value. The U.S. remains a strategic export market for Vietnamese pangasius, and as such, the outcome of this review has significant implications for the entire industry.
