On October 28, 2024, the US Department of Commerce officially initiated dual anti-dumping and countervailing duty investigations into fiber-cast products imported from Vietnam (Case Code: A-552-845 and C-552-846).
The products under investigation are fiber-cast products with HS codes: 4823.61.0020, 4823.61.0040, 4823.69.0020, 4823.69.0040, 4823.90.1000. The countries under investigation include Vietnam and China and both are proposed to conduct dual anti-dumping/countervailing duty investigations.
According to data from the US International Trade Commission (ITC), in 2023, Vietnam exported about 50 million USD and accounted for about 9% of the total US imports. From the beginning of the year to August this year, Vietnam exported about 34.5 million USD.
– Period of anti-dumping and countervailing investigations:
+ Anti-dumping: From April 1, 2024 to September 30, 2024.
+ Countervailing: Year 2023
– Period of damage investigation: 03 years (2021-2023).
The alleged dumping margin against Vietnam fluctuates between 231.73% – 260.56%. This level is lower than the alleged dumping margin of China. Regarding the alleged subsidy margin against Vietnam, the DOC has not yet provided the alleged subsidy margin against Vietnam.
However, the subsidy programs under investigation include 26 subsidy programs from the Government, belonging to 6 different groups.
Up to now, DOC has not issued the Questionnaire on Quantity and Value (Q&V) for both anti-dumping and countervailing duty cases to collect information for the selection of mandatory respondents. Enterprises need to proactively register for an IA ACCESS account at the DOC’s electronic information portal (https://access.trade.gov/login.aspx) to update information on enterprises required to respond to the Questionnaire.
Particularly in the anti-dumping investigation case, in case they are not selected as mandatory respondents, enterprises need to submit separate applications for tax rates.
It is expected that DOC can issue preliminary conclusions as early as March 17, 2025 for anti-dumping investigations and as early as January 2, 2025 for countervailing investigations.
