On August 14, 2024, the U.S. Department of Commerce announced the initiation of an administrative review of several export products from Vietnam that are subject to anti-dumping/countervailing duties, including:
- Steel Nails: Case Code: A-552-818 (AD), Review Period: 07/01/2023 – 06/30/2024. Case Code: C-552-819 (CVD), Review Period: 01/01/2023 – 12/31/2023.
- Welded Stainless Pressure Pipe: Case Code: A-552-816 (AD); Review Period: 07/01/2023 – 06/30/2024.
- Passenger Vehicles & Light Trucks Tires: Case Code: C-552-829 (CVD); Review Period: 01/01/2023 – 12/31/2023.
According to U.S. law, within 35 days from the date of the announcement (expected on September 18, 2024), the DOC will select the mandatory respondents in these cases based on the export volume of the companies from high to low according to data from U.S. Customs and Border Protection or the Quantity and Value questionnaire responses.
If a company is not listed for investigation, it should actively contact the DOC, register as an interested party, and participate in the review process within 30 days from the announcement of the initiation of the review. Within 90 days from the announcement date, parties may withdraw their review request.
Currently, Vietnam is still considered a non-market economy by the United States; therefore, to be eligible for separate rates, companies must submit an application for a separate rate within 30 days from the announcement of the initiation of the review. If a company does not apply for a separate rate and is not selected as a mandatory respondent, it may be subject to the national rate, which is usually unfavorable for the company.
The DOC is expected to issue its review conclusion by July 31, 2025, at the latest. In the near future, the DOC will require parties to provide information to select countries and values as substitutes for Vietnam (usually Indonesia in such investigations), as well as issue the Quantity and Value questionnaire and the questionnaire for mandatory respondents.
