On September 20, 2024, the Republic of South Africa officially initiated an anti-circumvention investigation concerning anti-dumping duties on tires for cars, buses, and trucks from Thailand, Cambodia, and Vietnam. The investigation alleges circumvention of anti-dumping duties currently applied to products originating from China. Specifically, the investigation covers:
The investigated products include tires for cars, buses, and trucks classified under HS codes 4011.10.01, 4011.10.03, 4011.10.05, 4011.10.07, 4011.10.09, 4011.20.16, 4011.20.18, and 4011.20.26.
The petitioner in the case is the South African Tire Manufacturers Association, which submitted a valid application on September 20, 2024. The anti-dumping investigation period is from November 1, 2023, to May 31, 2024. The anti-circumvention investigation periods are as follows: March 1, 2022, to September 30, 2022; October 1, 2022, to April 30, 2023; April 1, 2023, to October 31, 2023; and November 1, 2023, to May 31, 2024.
The alleged dumping margin for Vietnam is 84%. Previously, in May 2023, the South African International Trade Administration Commission (ITAC) issued a decision imposing anti-dumping duties on tires for cars, buses, and trucks originating from or imported from China, ranging from 7.18% to 43.60%.
Within 7 days of the investigation’s initiation, ITAC will send an official questionnaire to relevant Vietnamese manufacturers and exporters, along with other related documents.
The deadline for submitting responses to the questionnaire is 30 days, by 15:00 on October 28, 2024 (South African time). Should the parties have any arguments or comments on the case, the relevant manufacturers and exporters may also submit proposals to the investigating authority.
In the next phase of the investigation, ITAC will issue preliminary findings, final conclusions, conduct on-site inspections, and hold hearings to verify information before making a final decision regarding the circumvention behavior, the injury to the domestic industry, and the causal relationship.
