On October 31, 2024, the Minister of Education and Training of Vietnam issued Decision No. 3278/QD-BGDDT, announcing the amended administrative procedures in education and training with foreign countries under the management of the Ministry of Education and Training of Vietnam. This includes the detailed procedure for establishing a representative office of a foreign educational institution in Vietnam.
Implementation Order
- Submission of Application: The foreign educational institution or organization requesting permission to establish a representative office in Vietnam must submit an application to the Ministry of Education and Training of Vietnam.
- Feedback Collection:
- Within 5 working days of receiving a complete application, the Ministry of Education and Training will gather feedback from relevant agencies, units, and local authorities.
- These entities must provide written feedback within 15 working days of receiving the request.
- After receiving feedback, the Ministry will issue a decision to permit the establishment of the representative office within 5 working days, using Form No. 19 provided in Decree No. 124/2024/ND-CP.
- If the application is rejected, the applicant will be notified in writing with an explanation.
- Notification for Inadequate Applications:
- If the application is incomplete, the Ministry will issue a written notice within 5 working days. The notice may be delivered in person, through postal services, or via email, requesting the applicant to provide additional documents or correct deficiencies.
Implementation Methods
Applications can be submitted:
- In-person,
- Through postal services, or
- Via online public service portals.
The application must include the following documents:
- Written Request: A written request for permission to establish a representative office, following Form No. 18 in the Appendix of Decree No. 86/2018/ND-CP.
- Proof of Legal Status: A document verifying the legal status of the foreign educational institution or organization.
- Operational Charter: Certified copies or copies accompanied by originals for comparison, outlining the operational charter of the foreign educational institution or organization.
- Quality Accreditation Certificate: A certificate confirming the institution’s educational quality, issued by a competent authority.
- Summary Report: A summarized report on the establishment and development of a foreign educational institution or organization.
- Draft Regulations: Draft operational and organizational regulations for the representative office in Vietnam.
- Introduction of the Head: A written introduction of the proposed head of the representative office, including their background.
- Consular Legalization: Any written confirmation issued by a foreign authority must be consularly legalized by the Ministry of Foreign Affairs of Vietnam, or a diplomatic representative mission, consulate, or authorized authority performing consular functions for Vietnam abroad. This requirement is waived if international treaties to which Vietnam is a signatory state otherwise.
One complete application is required.
