The 2024 Land Law, No. 31/2024/QH15, will officially rename the certificate of land use rights, commonly known as the “Red Book”. Specifically, starting from 2025, the Red Book issued to Vietnamese citizens will officially be called the Certificate of Land Use Rights, Ownership of Assets Attached to Land.
The Certificate of Land Use Rights, Ownership of Assets Attached to Land is a legal document by which the State confirms the lawful land use rights and ownership of assets attached to the land for Vietnamese citizens.
Details include:
- Land use rights: the rights of entities to exploit the utility, enjoy the benefits and returns from using land allocated, leased, or transferred by the State, or through exchanges, transfers, leases, subleases, inheritance, gifting, etc., from other entities with land use rights.
- Ownership of assets attached to land: the owner’s rights to:
- Assets attached to land including houses and constructions within residential development projects;
- Individual houses as defined by the Housing Law;
- Other constructions;
- Perennial crops, production forests that are planted forests, or other items attached to the land as stipulated by law.
Compared to the 2013 Land Law, the new name for the certificate of land use rights and ownership of assets attached to land is more concise, simplifying “ownership of houses and other assets attached to land” to “ownership of assets attached to land”.
This is the third time in the last 20 years that Vietnam has changed the name of documents proving land use rights and ownership of assets attached to land. Specifically, the 2003 Land Law named it the “Certificate of Land Use Rights”, while the 2013 Land Law called it the “Certificate of Land Use Rights, Ownership of Houses, and Other Assets Attached to Land”. The 2024 Land Law shortens this to “Certificate of Land Use Rights, Ownership of Assets Attached to Land”.
Besides the name change, it is important for Red Book holders to note that certificates with the old names issued before 2025 will remain valid and legally equivalent to those with the new name. There is no urgent need for reissuing under the new title. However, should citizens wish to, state authorities will accommodate requests to reissue the certificates under the new format.
The new design for the Certificate of Land Use Rights, Ownership of Assets Attached to Land is proposed by the Minister of Natural Resources and Environment. Citizens interested in contributing their opinions on the new design can send their feedback to the Ministry of Natural Resources and Environment.
Noteworthy changes include the relocation of information about the land plot (plot number, land type, usage term, usage origin, and previous address) from the second page to the first page. Similarly, details about assets attached to the land, notes, plot diagrams, and certification by the competent authority are also moved to the first page.
The information table for assets attached to the land now includes new details such as: asset/building category name; construction area (m2); floor area or capacity; primary structure; construction grade; number of floors; completion year; and ownership term.
The second page will only contain information about “changes after the issuance of the certificate” and “registration number after certificate issuance”.
