In a recent announcement, the Myanmar Intellectual Property Department revealed that it will accept applications for industrial designs starting February 1, 2024. This notification, identified as No. 1/2024, marks a significant milestone for individuals and entities seeking to protect their Industrial Design in Myanmar.
Application Requirements
Myanmar adheres to the latest Locarno Classification, established under the Locarno Agreement of 1968, ensuring alignment with international standards in industrial design registration. Applicants can submit their applications in either Myanmar or English language, provided they meet the following requirements:
- Deed of Assignment: If the applicant is not the creator, a deed of assignment is required to demonstrate the applicant’s right to apply.
- Applicant’s Details: This includes the name, address, and identification number (passport or Myanmar citizenship scrutiny card for individuals; legal incorporation ID for entities).
- Local Representative Appointment: A notarized form appointing a local representative is necessary if applicable.
- Creator’s Information: Name, nationality, and address of the creator.
- Locarno Classification: Specify the relevant classification and subclassification for the product associated with the industrial design.
- Representation of the Design: Provide a drawn, photographic, or graphic representation of the industrial design.
- Product Indication: Indicate the product described in the Locarno Classification.
- Written Description: A concise description (up to 100 words) explaining the representation of the industrial design.
- Number of Designs: Applicants can submit up to 100 industrial designs under the same Locarno Classification.
- Publication Deferment: Indicate if a deferment for publication is required.
- Notarization: Ensure that the ID-2 form is notarized by a Notarial Services Attorney.
It’s worth noting that applicants have the option to initially file a COPY of the ID-2 form and subsequently submit the ORIGINAL document later. Each applicant must sign their respective ID-2 form, with notarization stamps appearing on each additional page attached to the form.
Upon submission, the registration term for an industrial design spans five years from the date of application. This registration period can be renewed twice, with each renewal extending the protection for an additional five years.
