India Strengthens Patent System with Amendment Rules

India has recently updated its patent rules to address concerns raised by those applying for patents in the country. These changes, known as the Patents (Amendment) Rules, 2023, were discussed with stakeholders in August 2023 and officially announced on March 15, 2024. Interestingly, this announcement coincided with the Indian Patent Office granting an impressive 100,000 patents in the current financial year. This shows a significant step forward in India’s efforts to support innovation and protect intellectual property.

The updated rules aim to make the process of patent filing and approval smoother and more efficient. They tackle various issues, such as the requirement to report on how patents are being used in India, the timing of certain filings, and the need for certain forms and documents.

Here are some of the key changes brought about by these new rules:

  1. Changes to Filing Deadlines: The deadline for submitting a Request for Examination (RFE) has been shortened from 48 months to 31 months from the date of the earliest application. This change applies to applications filed on or after March 15, 2024.
  2. Simplification of Form Filing for Foreign Applications: Patent applicants now only need to submit certain forms regarding foreign applications twice instead of multiple times. These forms must be submitted along with the initial application or shortly after, and then again after the First Examination Report (FER) is issued.
  3. Use of Available Databases by Controllers: Controllers evaluating foreign applications can now use existing databases to gather information. However, they may still ask applicants to submit additional forms if needed.
  4. Changes to Working Statement Requirements: Patent holders now need to submit reports on how their patents are being used every three years, instead of annually. They also no longer need to provide specific sales data for patents in India.
  5. Divisional Applications: Applicants can now choose to file divisional applications to protect different aspects of their inventions disclosed in previous applications.

These changes aim to make the patent process more straightforward and encourage more people to file for patents in India, both from within the country and internationally. By making the system more efficient, India hopes to support innovation and economic growth.
