On February 16, 2024, the Indian Directorate General of Trade Remedies (DGTR) issued a notice initiating an anti-dumping and countervailing investigation on tempered coated and uncoated glass products originating from or imported from Vietnam.
DGTR is investigating allegations of dumping and subsidies on ‘Textured Tempered Coated and Uncoated Glass’ produced or imported from China and Vietnam. This product is also known by various other names such as solar energy glass or photovoltaic glass in the market. The petitioner is Borosil Renewables Limited representing the domestic manufacturing industry, requesting an investigation and imposition of anti-dumping and countervailing duties on imported products.
Based on a valid and complete request for investigation from the domestic manufacturing industry and after self-assessment, relying on the basic evidence submitted by the petitioner, DGTR has officially initiated anti-dumping and countervailing investigations on tempered glass, both coated and uncoated, from Vietnam and China.
If it is determined that dumping and subsidies exist and have caused material injury to domestic businesses, DGTR will propose the imposition of anti-dumping and countervailing duties on the imported products. The Ministry of Finance will be the final decision-making authority regarding the imposition of duties.
Currently, DGTR has indicated sufficient preliminary evidence showing that the product is being dumped in the domestic market of India by exporters from these two countries.
Previously, India has imposed anti-dumping duties on various products to counter low-priced imports from multiple countries, including China.
India initiates anti-dumping, countervailing probe on tempered coated and uncoated glass from Vietnam
India has initiated anti-dumping and countervailing investigations on coated and uncoated tempered glass from Vietnam. The investigated goods are classified under HS codes 7003.1990, 7005.1010, 7005.1090, 7005.2190, 7005.2990, 7005.3090, 7007.1900, 7007.2190, 7007.2900, 7016.9000, 7020.0090, and 8541.4011. This product is used as a component of solar panels and in solar thermal applications.
The investigating authority has established a period of investigation (POI) from January 1, 2023, to December 31, 2023 (12 months). Manufacturers/exporters identified in Vietnam and the Government of Vietnam, as well as importers and users in India related to the investigated goods, must submit all relevant information within 30 days from the notification date according to the guidelines for providing information, the deadline for providing information, and other related content.
With strong foreign investment inflows, Vietnam has become a major producer of solar panels globally. This is not the first time solar panels in Vietnam have been investigated for dumping and subsidies. The US Department of Commerce initiated a similar investigation in late March 2022 concerning solar energy modules imported from Vietnam, Thailand, Malaysia, and Cambodia.
However, due to the clean energy goals of the United States, the imposition of trade defense duties on Vietnam has been temporarily postponed.
