The Vietnam Ministry of Education and Training is collecting comments on the draft Decree amending and supplementing a number of articles of Decree No. 86/2018/ND-CP regulating cooperation and investment with foreign countries in the field of education.
The Ministry of Education and Training said that in 2019 and 2020, the Ministry has carried out activities to review, examine and evaluate the implementation of the provisions of the law on cooperation and investment with foreign educational institutions, including the implementation of Decree No. 86/2018/ND-CP stipulating cooperation and investment with foreign countries in the field of education.
The review reports show that, after 3 years of implementation, in addition to remarkable results in creating a legal corridor for foreign individuals and organizations to participate in the educational development of Vietnam, Decree No. 86 also revealed a number of inadequacies, not consistent with reality, and some regulations were not in sync with newly promulgated laws.
Therefore, in order to solve problems, shortcomings and ensure legitimacy in law-making activities, the draft Decree amending and supplementing a number of articles of Decree No. The Government considers and promulgates it is necessary.
The draft Decree regulating cooperation and investment with foreign countries in the field of education
The view of the Decree formulation is to ensure state management, protect the interests of learners, improve the quality and efficiency of cooperation and foreign investment in the field of education and training, in line with the views of the Party and Government on international integration in the field of education. At the same time, create favorable conditions for attracting quality and selective foreign investment and cooperation, ensuring the comprehensive development of Vietnamese people with ethics, knowledge, culture, health, aesthetics, and profession; have the qualities, capacity, and sense of citizenship.
The draft Decree amending and supplementing focuses on regulations on management of factors related to educational programs, learners, conditions to ensure education quality and publicity and transparency of foreign factors.
The draft also adds regulations on specific disclosure of foreign factors for educational institutions such as: (i) Foreign education programs and accreditation; (ii) foreign teachers; (iii) student nationality to ensure information transparency.
Supplementing regulations on registration for implementation of foreign educational programs for Vietnamese students for foreign-invested educational institutions newly established or just starting to teach foreign educational programs outside. The objective is that foreign education programs taught to Vietnamese students must be programs recognized by competent authorities, ensuring the interests of learners.
Additional responsibilities for inspection, supervision, assessment, and settlement of complaints and denunciations, handling of violations according to their competence, clearly stating the responsibilities of localities in the management of educational institutions with foreign elements.
Amend a number of contents in the regulations on physical foundations and equipment of foreign-invested educational institutions to be consistent with current regulations on principles and regulations for foreign investment in the education sector is not lower than domestic investment.
