The U.S. Department of Commerce (DOC) has announced its preliminary determination in the countervailing duty investigation concerning concrete reinforcing steel imported from Vietnam, Algeria, and Egypt. The investigation was officially initiated by the DOC on 30 June 2025 based on a petition filed by the U.S. domestic industry. The key elements of the preliminary determination are as follows:
First, regarding the product under investigation: the subject merchandise is concrete reinforcing steel bar, classified under HS codes 7213.10.0000, 7214.20.0000, 7228.30.8010, 7221.00.0017, 7221.00.0018, 7221.00.0030, 7221.00.0045, 7222.11.0001, 7222.11.0057, 7222.11.0059, 7222.30.0001, 7227.20.0080, 7227.90.6030, 7227.90.6035, 7227.90.6040, 7228.20.1000, and 7228.60.6000.
Second, regarding the respondent companies: the DOC selected one Vietnamese enterprise as the mandatory respondent in this investigation. A total of ten affiliated companies of this enterprise were also examined within the scope of the investigation.
Third, regarding the provisional countervailing duty rates: the DOC determined a preliminary countervailing duty rate of 1.08% applicable to the mandatory respondent and its affiliated companies. For other Vietnamese producers and exporters, the applicable rate is likewise 1.08%, based on the rate assigned to the sole mandatory respondent.
This outcome is assessed as positive for Vietnamese enterprises, particularly in light of the fact that the preliminary subsidy margin for imports from Vietnam is currently the lowest among the countries under investigation, compared with preliminary rates of 72.94% for Algeria and 29.51% for Egypt.
However, concurrently with the issuance of the preliminary determination, the DOC also announced the initiation of investigations into nine newly alleged subsidy programs related to concrete reinforcing steel products. The DOC is expected to shortly issue supplemental questionnaires to Vietnamese enterprises and the Government of Vietnam to serve as the basis for its examination, assessment, and conclusions regarding these programs.
With respect to subsequent procedures, the DOC plans to conduct on-site verification to verify the information submitted by Vietnamese enterprises. The results of the verification will constitute an important basis for the DOC to issue its final determination and establish the definitive countervailing duty rates.
Interested parties are entitled to submit case briefs no later than seven days from the date the DOC issues the final verification report; rebuttal briefs responding to other parties’ comments must be filed within five days after the deadline for case briefs. Upon request by the parties, the DOC may hold a hearing prior to issuing its final determination.
The Trade Remedies Authority recommends that the relevant enterprises continue to cooperate fully and proactively with the DOC in responding to subsequent questionnaires, while thoroughly preparing for and closely coordinating during the upcoming verification. The timely review and submission of comments on the DOC’s preliminary determination, where necessary, are also essential to best protect the lawful rights and interests of the enterprises concerned.
