On January 31, 2025, the Canada Border Services Agency (CBSA) issued the final determination of its review of normal values and export prices for oil country tubular goods (OCTG) from Vietnam, along with several other countries.
On June 27, 2024, the CBSA announced the initiation of a review of normal values and export prices for OCTG imports from multiple countries, including Vietnam. The OCTG products under review are classified under the following HS codes: 7304.29; 7306.29; 7304.39; 7304.59; 7306.30; 7306.50; 7306.90.
According to the Canadian investigating authority, exporters subject to the review were required to submit responses to the Request for Information (RFI) by August 6, 2024 (Canada time). Failure to cooperate could result in an anti-dumping duty of up to 37.4%.
Notably, in this review, certain exporters/manufacturers from Taiwan-China, India, South Korea, and Thailand received preferential individual duty rates for their cooperation and full compliance with CBSA’s information requests in good faith. These individual rates will apply to future shipments entering Canada starting January 31, 2025.
However, some Vietnamese companies that either did not participate or provided incomplete information as required by CBSA were subject to the highest anti-dumping duty rate of 37.4%.
According to data from the General Department of Vietnam Customs, Vietnam’s OCTG exports are relatively insignificant, reaching approximately USD 10 million in 2023 and over USD 9 million in 2024.
This serves as a cautionary lesson for Vietnamese businesses involved in this case specifically, and for other companies engaged in international trade more broadly. It underscores the importance of full and good-faith cooperation during investigations and reviews to avoid unfavorable duties and the loss of market opportunities in target countries.
