On September 11, 2024, the U.S. Department of Commerce (DOC) published the final conclusion regarding the first end-of-term review of the anti-dumping and countervailing duties on laminated woven sacks imported from Vietnam.
The DOC had initially imposed these duties on June 4, 2019, and initiated the first end-of-term review on May 1, 2024.
The products under investigation are laminated woven sacks imported from Vietnam, classified under HS codes 6305.33.0040, 3917.39.0050, 3921.90.1100, 3921.90.1500, 3923.21.0080, 3923.21.0095, 3923.29.0000, 4601.99.0500, 4601.99.9000, 4602.90.0000, and 5903.90.2500.
In this case, the DOC conducted an expedited end-of-term review over 120 days due to the lack of responses from the related exporters.
The DOC concluded that ending the anti-dumping and countervailing duties on imported laminated woven sacks from Vietnam would likely result in the continuation or recurrence of dumping at an average weighted margin of 292.61% and a countervailing duty margin of 3.02% (with one non-cooperating company facing a countervailing duty of 198.87%). Consequently, the DOC will maintain the anti-dumping and countervailing duties on woven sacks from Vietnam for an additional five years.
New Vietnamese exporters wishing to export these products to the U.S. need to contact the DOC to request a new shipper review; otherwise, they will face a general anti-dumping duty of 292.61% and a countervailing duty of 3.02%. Companies that have previously exported to the U.S. and are currently subject to existing duties can request an administrative review to adjust their annual duty rates.
