On July 12, 2024, the U.S. Department of Commerce (DOC) issued a notice extending the deadline for the final conclusion of the product scope review and the preliminary conclusion of the anti-circumvention investigation concerning trade remedy measures on Vietnamese aluminum cable products.
On December 23, 2019, the United States imposed anti-dumping and countervailing duties on aluminum cable products originating from China, with anti-dumping duties ranging from 58.51% to 63.47% and countervailing duties ranging from 33.44% to 165.63%.
On October 19, 2023, the DOC initiated an investigation into the product scope and anti-circumvention measures against the anti-dumping and countervailing duties currently applied to aluminum wire cable (AWC) from China concerning Vietnam, Cambodia, and South Korea.
The investigation covers AWC originating from China that has undergone further processing in Vietnam before being exported to the United States as goods of Vietnamese origin.
The products under investigation are aluminum cables with HS codes 8544.49.9000 and 8544.42.9090. The DOC alleges that finished aluminum cables exported from Vietnam to the United States using input materials originating from China, such as stranded wires or unfinished aluminum cables, without significant transformation, fall within or circumvent the original anti-dumping and countervailing duty orders against China.
Due to the complexity of the case, requiring additional time to research and verify the content of responses from involved parties, the DOC announced the extension of the final conclusion for the product scope investigation from July 12, 2024, by an additional 12 days to July 24, 2024.
This extension also applies to the time for issuing the preliminary conclusion of the anti-circumvention investigation concerning trade remedy measures on Vietnamese aluminum cable products.
To protect their rights and interests, Vietnamese export enterprises need to closely monitor the preliminary and final conclusions mentioned above by the DOC and submit appropriate comments within the stipulated time frame. They should also coordinate with reputable anti-dumping and trade remedy law firms in Vietnam and internationally.
