On May 7, 2024, the U.S. Department of Commerce (DOC) issued a preliminary conclusion in the anti-dumping investigation on extruded aluminum and aluminum products from Vietnam.
On October 24, 2023, the DOC officially announced the initiation of an anti-dumping investigation on extruded aluminum and aluminum products imported from 15 countries/territories, including Vietnam. The investigation was initiated following a petition from the U.S. Coalition of Aluminum, Steel, Paper, and Forestry, Rubber, Industrial, Energy, Trade, and Services.
Countries subject to the anti-dumping investigation on imported extruded aluminum and aluminum products into the U.S. include Colombia, the Dominican Republic, Ecuador, India, Indonesia, Italy, Malaysia, Mexico, China, South Korea, Taiwan, Thailand, Turkey, the United Arab Emirates, and Vietnam.
In addition to the anti-dumping investigation, four countries are also being investigated for subsidies on extruded aluminum and certain other aluminum products: Indonesia, Mexico, China, and Turkey. The anti-dumping investigation period spans from April 1 to September 30, 2023.
According to the petitioners, based on U.S. Customs data, in 2022, Vietnam accounted for approximately 7.6% of the total export value of the investigated countries to the U.S., ranking fourth among the top exporters to the U.S.
On April 19, 2024, the petitioners filed an emergency complaint due to a significant increase of 36.07% in the export volume of the investigated products from Vietnam to the U.S. from October 2023 to February 2024 compared to the previous five-month period.
Under U.S. law, if the DOC determines an emergency situation exists, it is authorized to apply retrospective measures on shipments from Vietnam up to 90 days before the preliminary duty imposition date. This regulation aims to prevent a surge of investigated goods being exported to the U.S. in the initial phase of the case, before preliminary measures are applied.
On May 1, 2024, the DOC issued a preliminary conclusion on the scope of goods under investigation. The DOC also allowed parties to continue commenting on the product scope until June 5, 2024.
On May 7, 2024, the DOC published the preliminary conclusion of the case. Accordingly, the DOC determined a dumping margin of 2.85% for the remaining mandatory respondents. Twenty-eight companies meeting the conditions for separate rates are also subject to this margin. Other companies face a nationwide rate equal to the margin alleged by the petitioners, which is 41.84%.
Next, the DOC plans to conduct on-site verification for the mandatory respondents and issue the final conclusion no later than 135 days after the preliminary conclusion is published (expected by September 19, 2024).
