On May 3, 2024, the Vietnam Trade Remedies Authority officially announced the receipt of complete and valid dossiers requesting an investigation into the application of anti-dumping measures on galvanized steel from China and South Korea since the opening of the dossier reception on April 19, 2024.
According to the provisions of Clause 3, Article 49 of Decree No. 10/2018/ND-CP, within 45 days from the date of confirming the completeness and validity of the dossier, the investigating agency will evaluate the dossier to submit to the Minister of Industry and Trade for consideration of initiating or not initiating an investigation into the case.
If necessary, the issuance of a decision to initiate an investigation may be extended but not more than 30 days.
The contents of the dossier evaluation request include:
a) Identification of the legal representative status for the domestic manufacturing sector of the organization or individual submitting the dossier;
b) Identification of evidence that excessive imports of goods into Vietnam have caused or threatened to cause serious damage to the domestic manufacturing sector.
To serve the evaluation process and ensure the legitimate rights and interests of businesses, domestic enterprises producing/trading similar goods as mentioned above need to provide the following information:
- Information about the enterprise;
- Designed capacity and production output of galvanized steel products from 2019 to 2023;
- Company’s opinions on the case (agree, disagree, no opinion);
- Any other documents/evidence that the company considers relevant to the case.
The deadline for providing the above information is May 20, 2024.
It is noteworthy that when determining serious damage and the threat of serious damage to the domestic manufacturing sector, the investigating agency will consider the following factors as stipulated in Clause 1, Article 54 of Decree No. 10/2018/ND-CP:
a) The extent of the increase in volume or quantity of imported goods absolutely or relatively compared to the volume or quantity of similar goods or directly competing goods produced domestically;
b) The extent of the increase in volume or quantity of imported goods as specified in point a due to the impact of unforeseen developments;
c) The impact on the price of the investigated imported goods on the price of similar goods or directly competing goods produced domestically;
d) The impact of the increased importation of investigated goods on the domestic manufacturing sector through factors: Market share, revenue, production volume, designed capacity, capacity utilization, profit, labor, inventory, and other factors that the investigating agency determines to be appropriate.
The investigation period for determining serious damage or the threat of serious damage to the domestic manufacturing sector is 03 years. In case the domestic manufacturing sector has been operating for less than 03 years, the data collected will be the entire operating time of the domestic manufacturing sector up to the time when the Minister of Industry and Trade decides to initiate an investigation.
