On July 4, 2025, the Ministry of Industry and Trade of Vietnam issued Decision No. 1958/QD-BCT, rejecting the proposed price undertaking in the anti-dumping investigation on certain hot-rolled steel products originating from the Republic of India and the People’s Republic of China (case code AD20). According to the Decision, the undertaking submitted by the China Iron and Steel Association (CISA), on behalf of 16 Chinese manufacturers and exporters, was not accepted.
Previously, on June 6, 2025, the Ministry had received CISA’s price undertaking proposal in accordance with Articles 77 and 81 of the Law on Foreign Trade Management. Based on this proposal, the Ministry consulted the Ministry of Finance (General Department of Customs) and other relevant parties regarding the proposed minimum price level, the price monitoring mechanism, and import volume control measures as suggested by CISA.
After consolidating all opinions, the Ministry of Industry and Trade concluded that the proposal could not be accepted for the following reasons:
- Only parties that fully cooperate during the investigation are eligible for consideration of undertaking;
- The volume covered under the undertaking is insufficient to eliminate the material injury to the domestic industry;
- The proposed minimum price level is inadequate to remedy the injury suffered by the domestic industry;
- The reference price is not publicly disclosed, making it difficult to monitor and compare;
- There is currently no effective customs mechanism in place to monitor implementation of the undertaking;
- Accepting the undertaking without a clear monitoring mechanism may create loopholes for circumvention of anti-dumping measures;
- The undertaking fails to effectively address the material injury to the domestic industry.
Decision No. 1958/QD-BCT reflects a cautious stance by the Vietnamese Government in safeguarding the legitimate interests of the domestic steel industry amid increasingly complex trade competition.
