On June 14, 2024, the Vietnam Trade Remedies Authority (TRA) issued a notice confirming that the dossier requesting an investigation into the application of anti-dumping measures on hot rolled steel (HRC) from India and China was complete and valid according to trade remedy laws.
On March 19, 2024, the TRA received a dossier requesting an anti-dumping investigation on hot rolled steel products originating from China and India, submitted by several Vietnamese steel manufacturers.
In early April 2024, the Anti-Dumping and Subsidy Investigation Department of the TRA issued an official notice requesting the steel companies to provide additional information regarding the case to establish a basis for initiating the investigation.
On April 26, 2024, the applicants submitted supplementary information and documents as requested by the investigative agency. By May 13, 2024, the TRA issued a notice requesting the applicants to further supplement certain contents of the investigation request dossier for the second time.
On May 31, 2024, the applicants completed the submission of the additional information and documents as required by the investigative agency. On June 14, 2024, the TRA confirmed that the dossier was complete and valid according to trade remedy laws.
According to Vietnam’s trade remedy regulations, within 45 days of receiving a complete and valid dossier, the investigative agency will assess the dossier to present it to the Minister of Industry and Trade for consideration of whether to proceed with the investigation.
During the assessment process, the TRA will thoroughly and objectively review and evaluate the information in accordance with the law.
The assessment of the dossier includes: (i) Determining the legal representation status of the domestic industry by the organizations and individuals submitting the dossier according to the Foreign Trade Management Law; (ii) Identifying evidence of dumping of imported goods causing or threatening to cause significant damage to the domestic industry or significantly hindering the establishment of a domestic industry.
Businesses should prepare the following information in advance to avoid being unprepared when working with the investigative agency:
- Information about the type of business (manufacturing, trading, etc.);
- Design capacity and production volume of hot rolled steel products from 2020 to 2023;
- The company’s stance on the case (support, oppose, no opinion);
- Any other documents/evidence the company considers relevant to the case.
The deadline for providing the above information is July 5, 2024.
