On June 13, 2025, the Ministry of Industry and Trade (MOIT) of Vietnam issued Decision No. 1686/QD-BCT to initiate an end-of-term review of the application of anti-dumping and countervailing measures on certain sugar products originating from Thailand (case code: ER01.AD13-AS01).
This review is conducted in line with the regulations of the World Trade Organization (WTO) and Vietnamese trade remedy law, aiming to assess the necessity and effectiveness of maintaining the current trade remedy measures after four years of implementation.
Purpose of the End-of-term Review
As prescribed by law, an end-of-term review seeks to determine whether the termination of existing measures would likely lead to the recurrence or continuation of dumping and subsidization and whether such actions would cause significant injury to the domestic industry.
Additionally, the review evaluates the socio-economic impacts of maintaining or terminating these measures. Based on the findings, the Investigating Authority will decide whether to extend or remove the current anti-dumping and countervailing duties.
Investigation Process
Following the issuance of the initiation decision, the Trade Remedies Authority of Vietnam (TRAV), acting as the Investigating Authority, will distribute questionnaires to relevant stakeholders, including domestic producers, exporters, importers, distributors, and end users. The purpose is to collect information necessary to analyze:
- The likelihood of continued or recurring dumping and subsidization of sugar imports from Thailand if the measures are terminated;
- The potential injury to Vietnam’s domestic sugar industry in the absence of such measures;
- The causal link between the dumped/subsidized imports and the injury to the local industry.
After receiving submissions, the Authority will verify and assess the data to ensure the accuracy and objectivity of the final determination. The findings of this review will form the basis for the MOIT’s final decision on whether to maintain or revoke the existing trade remedy measures on sugar from Thailand.
Participation of Interested Parties
All organizations and individuals involved in the production, importation, distribution, or use of the investigated sugar products are encouraged to register as interested parties to ensure the protection of their legal rights and interests throughout the investigation.
Interested parties must complete the registration form provided in Appendix I of Circular No. 37/2019/TT-BCT. Submissions can be made electronically via the TRAV ONLINE system at: https://online.trav.gov.vn within 60 working days from the effective date of the initiation decision. Alternatively, registrations may be submitted via postal mail or email to the Investigating Authority.
