The Trade Remedies Authority of Vietnam (TRAV), under the Ministry of Industry and Trade, has officially announced the receipt of a request for a sunset review regarding the anti-dumping measures currently in force on certain H-shaped steel products imported from Malaysia.
Previously, on August 18, 2021, the Ministry of Industry and Trade issued Decision No. 1975/QĐ-BCT imposing definitive anti-dumping duties on certain H-shaped steel products originating from Malaysia, based on the findings of the investigation under case code AD12.
In accordance with Article 62 of Decree No. 10/2018/NĐ-CP, no later than 12 months prior to the expiration of the applied anti-dumping measures, the investigating authority is responsible for publicly announcing the receipt of sunset review requests.
A sunset review is a legal procedure to assess whether the termination of anti-dumping measures would likely lead to the continuation or recurrence of dumping practices and significant injury to the domestic industry.
Pursuant to Clause 2, Article 62 of the aforementioned Decree, within 30 days from the issuance date of this notice, domestic producers or organizations representing the domestic industry manufacturing similar H-shaped steel products may submit a request for a sunset review of the anti-dumping measures currently applied to the related products originating from Malaysia.
Requests submitted after the aforementioned deadline will not be accepted, except in cases where a legitimate reason is provided and approved by the investigating authority.
The final deadline for the Trade Remedies Authority of Vietnam to receive the sunset review request is June 30, 2025.
To protect their legitimate interests, manufacturers and exporters should familiarize themselves with the procedure and actively contact Vietnamese law firms specializing in anti-dumping and trade remedy for timely assistance.
