On July 29, 2024, the U.S. Department of Commerce (DOC) announced the initiation of the second administrative review of anti-dumping duties on honey from Vietnam. The review period covers June 1, 2023, to May 31, 2024.
On May 14, 2021, the DOC initiated an anti-dumping investigation on Vietnamese honey. The preliminary findings concluded with anti-dumping duties on Vietnamese honey products ranging from 410.93% to 413.99%.
On April 8, 2022, the DOC issued its final determination, significantly reducing the anti-dumping margin for Vietnamese honey to between 58.74% and 61.27%, approximately seven times lower than the preliminary findings, due to adjustments in the calculation method as proposed by Vietnam.
In June 2022, the DOC officially imposed anti-dumping duties ranging from 58.74% to 61.27% on Vietnamese honey imported into the United States for five years starting from June 3, 2022, with an annual administrative review of the duties.
The first administrative review of the anti-dumping duties on Vietnamese honey exports to the U.S. occurred in 2023, while the second review is taking place in 2024.
According to the latest DOC announcement, the list for the second review in 2024 is expected to include Vietnamese honey exporting companies. Vietnamese companies not named on the list but wishing to participate in the review must proactively contact the DOC within 30 days of the initiation notice (by August 28, 2024) for consideration.
Failure to fully cooperate or to register as an interested party may result in the company being subject to the often disadvantageous and significantly higher national duty rate compared to individual rates.
Under DOC regulations, within 35 days of the initiation notice (expected by September 2, 2024), the DOC will select mandatory respondents for the review based on the volume of exports, as reported by U.S. Customs and Border Protection (CBP).
Additionally, as the U.S. continues to classify Vietnam as a non-market economy despite recent efforts to alter this perception, Vietnamese companies must apply for separate rate status within 30 days of the initiation notice (by August 28, 2024) to be eligible for individual duty rates. Companies not applying for separate rate status and not selected as mandatory respondents will be subject to the national duty rate.
The DOC is expected to issue the review’s final conclusions by June 30, 2025.
