On May 23, 2025, the U.S. Department of Commerce (DOC) officially issued its preliminary determination in the anti-dumping investigation concerning hard gelatin capsules imported from Vietnam, classified under HS codes 9602.00.1040 and 9602.00.5010.
This investigation was initiated by the DOC on November 20, 2024, following a petition filed by U.S. domestic manufacturers. It was launched in parallel with a countervailing duty (CVD) investigation on the same product. The preliminary determination in the CVD case was previously issued on March 25, 2025.
During the investigation, the DOC selected one Vietnamese company as the mandatory respondent. Based on the information collected from this company, the DOC determined a preliminary dumping margin. Under U.S. trade remedy rules, the provisional anti-dumping duty applied to the mandatory respondent is also applied to all other Vietnamese exporters not individually examined in this case.
According to the preliminary determination, after adjusting for the export subsidy margin to avoid double counting, the provisional anti-dumping duty imposed on Vietnamese hard gelatin capsules is 8.35%.
In addition to Vietnam, the investigation also covers similar products originating from China, India, and Brazil. The preliminary duty margins for these countries are as follows:
- China: Adjusted dumping margins range from 5.4% to 172.24%; preliminary subsidy margins range from 3.45% to 8.53%.
- India: Adjusted dumping margins range from 0% to 14.91%; the preliminary subsidy margin is 9.95%.
- Brazil: The preliminary dumping margin is 77.29%; the preliminary subsidy margin is 4.94%.
Next Steps
In the coming period, the DOC is expected to conduct on-site verifications in Vietnam to confirm the accuracy and completeness of the information submitted by Vietnamese exporters during the investigation. These verifications are a critical basis for the DOC’s final determination on the definitive anti-dumping duty.
The final determination is anticipated to be issued by the end of 2025. It may result in adjustments to the duty rates—either increases or decreases—from those announced in the preliminary determination.
