The U.S. Department of Commerce (DOC) has issued a notice seeking public input on potential alternatives to the Cohen’s d test, which has been used for over a decade in anti-dumping investigations.
This initiative aims to comply with section 777A(d)(1)(B)(i) of the Tariff Act of 1930, as amended, which requires the DOC to determine whether “there is a pattern of export prices (or constructed export prices) for comparable merchandise that differ significantly among purchasers, regions, or time periods.”
The Cohen’s d test was previously used to assess the magnitude of price differences. However, a recent decision by the U.S. Court of Appeals for the Federal Circuit found that the application of this test was unreasonable due to its failure to meet necessary statistical assumptions, particularly regarding sample size, normal distribution, and homogeneity of variance. In response, the DOC is launching a public consultation to develop a more appropriate alternative.
