On March 25, 2025, the U.S. Department of Commerce announced its preliminary determination in the countervailing duty investigation concerning imports of hard gelatin capsules (HS codes 9602.00.1040 and 9602.00.5010) from Vietnam.
This investigation was initiated by the DOC on November 20, 2024, at the request of U.S. domestic producers. During the investigation, the DOC selected two mandatory respondents. However, one of the respondents confirmed that it did not export the investigated product to the U.S. during the period of review, leaving only one mandatory respondent.
According to the preliminary determination, the provisional countervailing duty rates are as follows:
- The sole mandatory respondent: 2.15%
- All other Vietnamese exporters: 2.15%, equivalent to the rate applied to the sole mandatory respondent.
In the next phase, the DOC is expected to conduct on-site verification to assess the accuracy of the information provided by Vietnamese companies. The results of this verification will be one of the key factors in the DOC’s final determination and the establishment of official duty rates.
Interested parties may submit comments on the case within seven days from the date the final verification report is issued. Additionally, rebuttal comments must be submitted within five days after the deadline for initial comments.
If requested by the parties, the DOC may hold a hearing before issuing its final determination, which is scheduled for August 5, 2025, unless an extension is granted.
Vietnamese hard gelatin capsules have gained significant market presence internationally, particularly in the U.S. In 2023, exports of this product to the U.S. reached approximately 26 million dollars, accounting for about 12 percent of total U.S. imports of hard gelatin capsules in the same year.
However, on November 13, 2024, the U.S. Department of Commerce initiated both anti-dumping and countervailing duty investigations into imports of hard gelatin capsules from Vietnam, along with Brazil, China, and India. The petitioner, Lonza Greenwood LLC, alleged that Vietnamese companies engaged in dumping with margins ranging from 63.53 percent to 86.04 percent and received government subsidies.
