On October 30, 2024, the U.S. International Trade Commission (ITC) issued its final determination on injury in the antidumping/countervailing duty investigation concerning imported extruded aluminum.
The United States has conducted antidumping and countervailing duty investigations on extruded aluminum products imported from China, Colombia, Ecuador, India, Indonesia, Italy, Malaysia, Mexico, South Korea, Taiwan, Thailand, Turkey, the United Arab Emirates, and Vietnam.
However, despite the Department of Commerce’s (DOC) finding of dumping or subsidization, the ITC determined that the U.S. industry was not materially injured by imported extruded aluminum from the 14 countries/territories under investigation.
This case is relatively rare, as the ITC’s conclusion denied the imposition of antidumping and countervailing duties, even when there was a finding of dumping/subsidization by the DOC. Typically, when the DOC issues a finding of dumping/subsidization, the ITC’s follow-up determination is that such practices harm domestic industries.
Products are only subject to antidumping/countervailing duties if both agencies issue affirming determinations, specifically: that dumping/subsidization exists, injury has resulted, and there is a causal link between the dumping/subsidization and the injury.
Under U.S. investigation protocols, two agencies participate in an antidumping/countervailing duty investigation: the DOC investigates dumping/subsidization behavior and is responsible for the overall findings, while the ITC is responsible for assessing injury to the domestic industry.
As a result, based on the USITC’s determination, the DOC will not issue an antidumping/countervailing duty order on extruded aluminum imports from the 14 countries/territories listed above.
The trade remedy investigation into extruded aluminum products was initiated by the DOC on October 24, 2023, with Vietnam only under investigation for antidumping.
