On September 20, 2024, the U.S. Department of Commerce (DOC) announced the initiation of administrative reviews on certain Vietnamese exports currently subject to anti-dumping duties (AD), including:
- Frozen Fish Fillets (Pangasius – Basa): Case No.: A-552-801 (AD), Review Period: August 1, 2023 – July 31, 2024.
- Raw Honey: Case No.: A-552-833 (AD), Review Period: June 1, 2023 – May 31, 2024.
- Seamless Refined Copper Pipe and Tube: Case No.: A-552-831 (AD), Review Period: August 1, 2023 – July 31, 2024.
Within 35 days from the date of the initiation notice, the DOC will select mandatory respondents for the reviews.
According to the regulations, if a producer/exporter listed in the notice of initiation had no export activities during the review period, it must notify the DOC within 30 days from the date of the notice. The DOC will then decide how to handle the situation.
Additionally, within 90 days from the date of the notice, parties may withdraw their requests for review. The DOC may extend this 90-day period depending on the case.
For countries the U.S. considers non-market economies, such as Vietnam, interested parties must submit a separate rate application within 30 days of the notice to qualify for an individual duty rate. If a company fails to submit this application and is not selected as a mandatory respondent, it will be subject to the higher national rate by default.
The DOC is expected to issue its final determination in these reviews by August 31, 2025.
