Philippines ends safeguard investigation on imported steel gas cylinders from Vietnam

On August 26, 2024, the Philippine Department of Trade and Industry (DTI) issued Order No. 24-06 2024, deciding not to impose safeguard measures on imported steel gas cylinders. On March 29, 2023, DTI had previously issued a notice to accept a request to investigate the application of safeguard measures on imported steel gas cylinders into the country.

The investigated product includes imported steel LPG cylinders under AHTN code 73.11. The petitioner in the case was Ferrotech Steel Corporation, and the period of investigation (POI) was from 2017 to 2021.

According to Section 6 of RA 8800, DTI investigated and found sufficient grounds to initiate a preliminary safeguard investigation as requested for imports of steel gas cylinders from various countries. However, based on the latest publicly issued decision, the Philippines will not apply safeguard measures on these imported steel gas cylinders. The Philippine Bureau of Customs will issue implementation guidelines for DTI’s Order.

DTI’s decision was made based on the recommendation of the Philippine Tariff Commission (TC). After the investigation, the TC concluded that there was insufficient evidence to prove that the increase in imports of steel gas cylinders caused or threatened to cause serious injury to the domestic industry. Therefore, the investigation was terminated, and the TC recommended that DTI not apply safeguard measures.
