As of August this year, the process for initial registration of land and land-attached assets in Vietnam can now be conducted electronically, in accordance with the country’s land and e-transaction laws. This shift is outlined in the Government’s Decree 101, which focuses on land surveys, registration procedures, and the issuance of land use right certificates.
Key Provisions of Decree 101
Under Decree 101, an e-dossier for first-time registration of land and land-attached assets must include authenticated e-documents that contain the required information and data as specified by law. These e-certificates of land use rights and ownership of land-attached assets are managed within the National Land Information System and hold the same legal validity as traditional paper certificates.
Provincial-level People’s Committees are tasked with granting these e-certificates, provided that the necessary software, IT infrastructure, and information security measures are in place, as mandated by the e-transaction law. This is a significant modernization of the registration process, aiming to improve efficiency and accessibility.
Streamlined Administrative Procedures
One of the most notable changes under the new Decree is the reduction in the time frame for completing procedures related to the grant of land use right certificates. The processing time has been cut from 30 working days, as stipulated in Decree 43 of 2014, to 23 working days, expediting the overall process for landowners.
Decree 101 also introduces several other important updates to the land registration system, including:
- Six cases where changes in land and land-attached assets require registration when applying for land use right certificates.
- Nine cases that qualify for the renewal of previously granted certificates of land use rights and land-attached assets.
- New forms of land registration dossiers to further standardize and streamline the registration process.
The introduction of electronic registration under Decree 101 represents a significant step forward in Vietnam’s efforts to modernize its land administration system. By reducing administrative timelines and providing a secure platform for e-certificates, the government aims to make land registration more efficient.
