On July 8, 2024, the Directorate General of Trade Remedies (DGTR) announced the initiation of a sunset review investigation of countervailing duties on Vietnamese copper wire, as well as products from other countries/territories, including Indonesia, Malaysia, and Thailand.
The goods subject to the sunset review are copper wires with HS codes: 7407.1010, 7407.1020, 7408.1190, 7408.1920, 7408.1990, 7409.11, and 7409.19.
The countervailing duty on copper wire was imposed by the Ministry of Finance of India and has been effective for five years since January 8, 2020. The investigation is conducted at the request of the Indian Primary Copper Producers’ Association.
After five years of application, the DGTR is conducting a sunset review to assess the necessity of continuing the countervailing measures or the likelihood of recurrence of subsidization or injury/threat of injury to the domestic industry if the measures are terminated.
The current duty applied to imported copper wire from Vietnam to India is 7.13%. The period of investigation includes: (i) for subsidies: from January 1, 2023, to December 31, 2023 (12 months); and (ii) for injury: 2020-2021, 2021-2022, 2022-2023, and the subsidy investigation period.
The petitioner alleges that the termination of countervailing measures on copper wire products could lead to an increase in imports of copper wire from these countries into India, the continuation or recurrence of subsidization, and injury to the domestic industry.
The subsidy programs under investigation include those investigated in the original case, covering tax exemptions, export credits, export promotion, investment incentives, provision of goods and services at lower than normal prices, and new programs including provision of goods and services at below normal value and the purchase of cathode copper from Indonesia at below normal value.
Within 30 days from the date of receiving the initiation notice, relevant parties must submit their written responses to the DGTR’s questionnaire. If no responses are received within the specified period or if the provided information is incomplete or not submitted according to regulations, the DGTR will use available data to calculate the countervailing duty rates.
