Brazil Initiates Anti-Dumping Investigation on PET Plastic from Malaysia and Vietnam

Brazil’s Ministry of Development, Industry, Trade and Services has recently issued a notice initiating an anti-dumping investigation concerning polyethylene terephthalate (PET) plastic with an intrinsic viscosity between 0.78 and 0.88 dl/g, commonly classified under subheading 3907.61.00 of the Mercosur Common Nomenclature (NCM), originating from Malaysia and Vietnam. The investigation was prompted by allegations of dumping practices and material injury to the domestic industry.

The investigation was initiated based on the evidence presented in SEI case files No. 19972.002457/2024-75 (restricted version) and No. 19972.002456/2024-21 (confidential version), as well as Opinion No. 777 dated April 1, 2025, from the Trade Remedy Department (DECOM) under the Foreign Trade Secretariat (SECEX).

The evidence indicates signs of dumping in PET exports from Malaysia and Vietnam to Brazil, which have caused significant injury to the Brazilian domestic PET production industry.

The investigated product is polyethylene terephthalate (PET), also known as poly(ethylene terephthalate), with an intrinsic viscosity ranging from 0.78 to 0.88 dl/g. It is commonly used in the production of packaging such as plastic bottles, food containers, and beverage packaging. The product is classified under subheading 3907.61.00 of the NCM.

The investigation periods include:

  • Period for analysis of dumping indications: From July 2023 to June 2024.
  • Period for injury analysis: From July 2019 to June 2024.

In the coming period, the Trade Remedy Department of Brazil will send questionnaires to identified producers/exporters, importers, and domestic producers. The parties will have 30 days to respond from the date of receipt of the notice (or 7 days for foreign exporters, in accordance with the WTO Antidumping Agreement – GATT 1994). Timely responses will be used in determining the preliminary decision on whether to impose provisional measures.

The initiation of the investigation does not mean a definitive conclusion has been reached on the existence of dumping or injury caused by Vietnamese and Malaysian enterprises. A final decision will only be made upon the completion of the investigation, based on available evidence and the participation of relevant parties.

Therefore, proactive and cooperative participation in the investigation process is crucial for enterprises to obtain more favorable outcomes, rather than avoiding or refusing to respond to the questionnaire or cooperate with the investigating authority.
