Hello, I am wanting to Sue the company K. embroidery for fraud and scam. I am also wanting to sue PayPal

This is just the beginning of everything. I have so much evidence against this company that I will need another way to send all of the information.

Hello my name is Julianna, I am a small business owner and I am 1 of the 1,000+ affected by the manipulation and wrong doings of K. embroidery located in Vietnam. I make custom clothing designs. I started looking for a company to make my custom clothing, and this particular one came highly recommended. On June 2nd, I started talking to a lady named Jessi on facebook messenger that works with K. Embroidery. She explained to me that they could carry out my design vision, and typed up an invoice for me. The invoice total was $6131 this included the price of the items and the shipping or from what she told me at the beginning. The items were $5232 and the shipping was $899.50. She told me I could pay 50% now and 50% when the items were ready. So half of the total of $6131.50 was $3065.75 she asked me to send $3066 through PayPal. She said sending it through friends and family would mean no fees, but I did get charged fees of $94.20 which made the price $3160.00. On the invoice it has that the total time for production and delivery is 5-6 weeks. I placed the order on 6/11/2024, and I JUST NOW have received my products. Estimated time of arrival to me was mid to late July. I inquired about the production on July 1st and Jessi sent back “They are making it”. I placed another order on 07/02/24 and was told it would be 3-4 weeks, and I still do not have all of those items. When I asked her about it, she stated, “4-5 more weeks. 3-4 weeks is for 2-3 samples, we kinda overload with samples. I’m so sorry I will try to get it done soon.” The order for 7/4/24 was explained to be the same way, but I still have not received those items either. On July 13th, My order from June 11th was, according to her estimated time of arrival on the invoice, supposed to be shipping out to me. I still do not have that order instead, I was getting a message, asking about what fabric they could use for one of my outfits. So my 328 pc order was not even in production yet! On July 14th, I was asked again about a certain fabric. I told them no, and she said “My worker go to fabric market tomorrow, I will told them to find dark purple or gold stripe.” I said “yes, that works.” On July 18th, I thought I needed to go ahead and pay off my order from 6/11 because the production and delivery time was coming close, and I didn’t want to be caught on my heels so she sends back, “I did checked that one but to be honest! I’m not really sure about the postage. Can you make payment for the rest of the product? I will estimate the postage when it’s ready to ship.” I said, “Yeah I hope it’s not too much more I’m already paying like $7,000 for this. As much as I have had to pay it should be free.” She asked me to pay $2166 to cover the rest of the items. So with PayPal fees and the items on 7/20/24 I paid the rest of my order (although at this point we are on week 6 and my items should be getting ready to be delivered). It is now 9/11/24 and I STILL do not have them or any orders that I have ordered since June 11th. I also placed another order on July 15th for some French knot outfits. I was told and it is listed on my invoice as a 5-6 week turnaround time. I still do not have these. On 8/6/24 I was switched over to another rep with this company known as Smocked Heaven. I have asked Jessi over and over again about different orders I submitted with her and heard nothing about them. She just continued to say we need 2-3 weeks more. Smocked Heaven told me my French knot outfits (that I was supposed to get in August) would be ready some time this month (September). On July 22nd, I asked again about my 327 pc order, and was told per Jessi, “I’m not really sure about it, I know its been a while but it takes us more time than we thought to find the fabric.” I said, “can you give me an idea of when they will be done, I have customers asking because next week will be week 8.” She said she would ask and get back to me. On July 24th I got another message saying, “These are the closest color fabrics we can use for this one (it was another one of my designs from the 327 pc. Order and they still did not have fabric for it). This same day after she sent me another message asking about fabric i said, “When will all of these be ready? I need to update my customers with a new ETA.” She says, “In about 4-5 weeks, you paid at 12th of June, it has been six weeks (once again my invoice said that lead time for production and delivery was 5-6 weeks). I said, “So I should have them the third week in August?” She said, “Late August, I hope so.” I STILL DO NOT HAVE THEM AS OF 9/11/24. As of July 25th, they still did not have all of the fabrics needed for this order. July 28th – August 3rd, I got more messages, asking for better pictures that I wanted to go on my smock plates of my outfits and about more fabric. 8/6/24 I asked, “Where is my big order at in production?” I had to ask that twice, I stated that I have customers getting discouraged because it’s already way later than expected. She said, “Hi, it is in production now, As your order has a lot of fabric and designs. So TAT is definitely longer than normal order. Let me update you tomorrow.” I said, “You should have told me that from the beginning.” She said, “I told you we will finish at late August.” I never got another update on them from her. I asked about my samples from another order and she said Let me update you tomorrow. I asked her if I could just go ahead and switch to another rep, Smocked Heaven, and I did. On 8/2/24 I placed an order for samples. I had a new rep, she was telling me and reassuring me that my items would all be done soon. I still have not gotten any of these orders that I am disputing. I have continued to ask for updates on everything and I am just getting excuses about why they are being pushed out even longer. Here is the layout of my orders and when I was supposed to receive them. I can provide my invoices as well if I need to, and any text messages between the company and I. Order paid for on the 6/11/24 and 7/20/24 should have received it mid to late July. Order paid for on 7/2/24 I should have received Mid August. Order from 7/4/24 I should have received Mid August. Order from 7/15/24, I should have received Late August. Order from 7/20/24 I should have received late August. Order from 8/2/24 I should have received this week, and I haven’t even heard anything about it shipping to me. The payment from 8/30/24 was for shipping that the company says I didn’t pay for already but as I stated earlier on June 11th, I was quoted that my big order was $5232 with $899.50 for shipping and then I made the payment that day. I should not have had to pay $900 for more shipping, but according to the company, Smocked Heaven said, “If you don’t pay for shipping, the shipping company won’t be able to deliver the goods.” She stated, “so you ok with this right?” I said, “I mean I’m really not.” She said, “If that’s the case, I can’t ship the goods to you.” I stated they needed to pay it and how ridiculous everything was and that I would never order from their company again. Now I have reduced the 338 pc order and 27 pieces are wrong. 10 are completely wrong with the wrong lettering and everything and the other 17 is the completely wrong color. I am not the only one that has had difficulty from this company. If this ever went to trial I have so much evidence as well as people that would back me up on how pathetic this company is. They use you and manipulate you. So far the company is not willing to refund me full price for their mess ups. They have not even offered to compensate for any money that my small business has lost because of them. They are ruining our small businesses. Do you think I have a case? Thanks!
